File Compliance - Branch Manager Role

Manager must review and approve:

 

  1. All Listing Agreements (paying particular attention to Commission Amounts and if there is Representative Capacity by the Seller).
  1. Listings taken at less than Brokers Customary Commission must be addressed by a Broker Customary Commission Acknowledgement form and/or RCA.
  1. All Purchase Agreements (emphasis on paragraph #2 "Confirmation of Agency" being correct, and Representative Capacity box checked if title is held by an entity).
  1. All Counter Offers.
  1. All Addendums and Amendments.
  1. All Real Estate Transfer Disclosures Statements, Seller Property Questionnaire, and all AVIDs.
  1. Representative Capacity forms (if applicable - need to review Prelim to see if title held by a Trust, LLC, Partnership, or other entity)
  1. All Notices to Perform and Demands to Close Escrow (looking to be sure they were sent within the proper time frames and allow the minimum amount of time to perform).
  1. All Assignment of Agreement forms (when applicable)
  1. Any company participation commission reductions must be addressed immediately upon notification of possible reduction.

Other Company Requirements:

 

  1. All listing agreements must be reviewed within 48 hours of being submitted to SkySlope and/or date listing was taken.
  1. All listings must be fully executed before marketing of the listing begins. Signs will not be ordered unless we have a fully executed listing agreement.
  1. All purchase agreements must be reviewed within 48 hours of being submitted to SkySlope and/or date contract was accepted.
  1. All core broker required documents must be reviewed and accepted in the SkySlope file and appropriate file stage selected no later than 5 days prior to Close of Escrow for agent to be eligible to participate in Same Day Pay.
  1. All cancellations must be reviewed within 48 hours of cancellation.
  1. All closed SkySlope files must be completed and archived within 7 days of COE.
  1. All files, leases, listings, sales, referrals closing dates and expiration dates must be updated regularly.
  1. Manager must review all documents for files where a transaction coordinator is not used.
